These Terms of Service (these "Terms") govern the conditions of use of the iOS application "Climber Scope" (the "Service") provided by Noluba, LLC. ("we"). Users of the Service ("Users") agree to these Terms upon using the Service.

1. Application

These Terms apply to all relationships between Users and us concerning the Service.

2. Registration

Those wishing to use the Service must agree to these Terms and apply for registration via the method we designate. We may decline registration if we determine that the applicant falls under any of the following:

• Has submitted false information
• Has violated these Terms in the past
• Is under 13 years of age
• Other cases where we deem registration inappropriate

3. Management of User ID and Password

Users shall manage their User ID and password for the Service at their own responsibility. Users must not transfer, lend, or share their User ID and password with any third party under any circumstance.

4. Posted Content

Copyrights and other rights to videos, comments, and other content posted by Users ("Posted Content") belong to the respective User. However, Users grant us a non-exclusive, royalty-free license to use Posted Content (including reproduction, public transmission, adaptation, and analysis) for purposes of providing, improving, and promoting the Service, as well as developing, training, and validating our machine learning and artificial intelligence (AI) models.

We may use Posted Content for the development and training of our machine learning and AI models and for other purposes. Conversely, Users and any other third party must not collect, reproduce, analyze, or use Posted Content for the development or training of machine learning or AI models or for any other purpose without our prior written consent.

Users represent and warrant that they have the legitimate right to post, use, and license the Posted Content, and that the Posted Content does not infringe any third party's rights.

5. Prohibited Activities

Users must not engage in any of the following activities when using the Service:

• Acts that violate laws or public order and morals
• Acts related to criminal activity
• Acts that infringe upon a third party's intellectual property rights, portrait rights, privacy, honor, reputation, or other rights or interests
• Acts that damage or interfere with our servers or networks
• Acts that may interfere with the operation of the Service
• Acts of collecting or accumulating personal information of other Users
• Collecting, reproducing, analyzing, or using Posted Content or other content on the Service for the development or training of machine learning or artificial intelligence (AI) models or for any other purpose without our prior written consent
• Unauthorized access or attempts thereof
• Impersonating other Users
• Business activities, promotion, advertising, solicitation, or other for-profit activities through the Service in a manner not approved by us
• Providing benefits to anti-social forces
• Posting violent, sexual, racist, or otherwise inappropriate content
• Posting content that encourages dangerous activities
• Other acts that we deem inappropriate

6. Suspension of Service

We may suspend or interrupt all or part of the Service without prior notice to Users if we determine any of the following:

• When performing system maintenance or updates for the Service
• When provision of the Service becomes difficult due to force majeure including earthquakes, lightning, fire, power outage, or natural disasters
• When computers or communication lines stop due to accidents
• Other cases where we determine that provision of the Service is difficult

7. Usage Restrictions and Account Termination

We may, without prior notice, take measures such as deleting Posted Content, restricting the User's use of the Service, or terminating the User's account if the User falls under any of the following:

• Has violated any provision of these Terms
• It is found that registration information contains false information
• There is no response to our contact for a considerable period
• There has been no use of the Service for a considerable period since the last use
• Other cases where we determine that the use of the Service is inappropriate

8. Withdrawal

Users may withdraw from the Service via the method we designate.

9. Disclaimer of Warranties and Limitation of Liability

We do not warrant, expressly or impliedly, that the Service is free from defects in fact or in law (including defects, errors, bugs, and infringement of rights regarding safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, and security).

Except in cases of our willful misconduct or gross negligence, we accept no liability for any damages incurred by Users arising from the Service.

We accept no liability for disputes between Users or with third parties, and Users shall resolve them at their own responsibility.

10. Changes to Service Content

We may change, add, or discontinue the content of the Service with prior notice to Users, and Users consent to this.

11. Changes to Terms

We may change these Terms when we deem it necessary. Users who use the Service after the changes are deemed to have agreed to the revised Terms.

12. Handling of Personal Information

Personal information obtained through the use of the Service will be handled appropriately in accordance with our Privacy Policy.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our principal place of business.
